Oklahoma Prospects — Daily Schedule

FACILITY WAIVER & RELEASE

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS LEGAL RIGHTS.

1. Activities and inherent risks

I voluntarily choose to enter and participate in activities at Oklahoma Prospects, including baseball, softball, batting, pitching, throwing, catching, instruction, conditioning, cage or field rental, and use of equipment. I understand these activities involve inherent and other risks, including being struck by balls, bats or equipment; collisions; falls; equipment failure; overexertion; and serious injury, illness, disability, or death.

2. Assumption of risk

I knowingly and voluntarily accept all risks of participation and presence at the facility, whether known or unknown, except to the extent Oklahoma law does not permit a risk to be assumed or liability to be waived.

3. Release and covenant not to sue

To the fullest extent permitted by Oklahoma law, I release and agree not to sue Oklahoma Prospects, Prospects Baseball, and their owners, coaches, instructors, employees, agents, landlords, and affiliates for claims arising from ordinary negligence connected with the participant’s presence or activities. This release does not apply to gross negligence, reckless conduct, intentional misconduct, or any liability that cannot lawfully be released.

4. Rules, condition, and equipment

I will follow posted rules and staff instructions, use required safety equipment, inspect equipment before use, report unsafe conditions, and stop participating if the participant is injured, ill, or not physically able. I understand supervision is not guaranteed unless instruction is specifically booked.

5. Emergency care

If emergency care is reasonably necessary and I cannot be reached, I authorize facility staff to contact emergency services and consent to reasonable emergency treatment for the participant. I accept responsibility for resulting medical and transportation costs.

6. Minor participant

If signing for a minor, I confirm I am the minor’s parent or legal guardian, consent to participation, acknowledge the risks, and agree to these terms on my own behalf. I understand Oklahoma law may limit the effect of a parent’s release of a minor’s own legal claims.

7. Agreement terms

Oklahoma law governs this agreement. If one provision is unenforceable, the remaining provisions continue to the fullest extent allowed. My typed name, checked agreement box, and recorded acceptance time are intended as my electronic signature. I have had the opportunity to read this entire agreement and ask questions before signing.
